The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with statutory data protection regulations and this privacy policy.

When you use this website, various personal data are collected. Personal data is information that can be used to identify you personally. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this happens.

Please note that data transmission over the internet (e.g., when communicating via email) may have security vulnerabilities. It is not possible to completely protect data from access by third parties.

Information about the controller

The controller responsible for data processing on this website is:

Eckert & Partner
Consulting Engineers mbB
‍
Hammer Deich 70
20537 Hamburg
‍
Phone: +49 40 251538-0

The controller is the natural or legal person who, alone or jointly with others, decides on the purposes and means of processing personal data (e.g., names, email addresses, etc.).

Storage duration

Unless a more specific storage period has been stated in this privacy policy, your personal data will remain with us until the purpose for data processing no longer applies. If you assert a justified request for erasure or revoke your consent to data processing, your data will be deleted, provided that we have no other legally permissible reasons for storing your personal data (e.g., tax or commercial law retention periods); in the latter case, the deletion will take place after these reasons no longer apply.

General information on the legal basis for data processing on this website

If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR, provided that special categories of data are processed pursuant to Art. 9(1) GDPR. In the event of express consent to the transfer of personal data to third countries, data processing is also based on Art. 49(1)(a) GDPR. If you have consented to the storage of cookies or access to information on your device (e.g., via device fingerprinting), data processing is additionally based on Section 25(1) TDDDG. Consent can be revoked at any time. If your data is required for the fulfillment of a contract or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, we process your data if it is required for the fulfillment of a legal obligation on the basis of Art. 6(1)(c) GDPR. Data processing may also take place on the basis of our legitimate interest pursuant to Art. 6(1)(f) GDPR. Information regarding the relevant legal basis in each individual case is provided in the following paragraphs of this privacy policy.

Recipients of personal data

In the course of our business activities, we work with various external parties. In some cases, this requires the transmission of personal data to these external parties. We only pass on personal data to external parties if this is necessary for the fulfillment of a contract, if we are legally obliged to do so (e.g., disclosure of data to tax authorities), if we have a legitimate interest in the disclosure pursuant to Art. 6(1)(f) GDPR, or if another legal basis permits the disclosure of data. When using processors, we only pass on our customers' personal data on the basis of a valid data processing agreement. In the case of joint processing, a joint processing agreement is concluded.

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You may revoke consent you have already given at any time. The legality of the data processing carried out prior to the revocation remains unaffected by the revocation.

Right to object to data collection in special cases and to direct advertising (Art. 21 GDPR)

IF DATA PROCESSING IS BASED ON ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME, ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION, TO THE PROCESSING OF YOUR PERSONAL DATA; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS, AND FREEDOMS, OR IF THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE, OR DEFENSE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21(1) GDPR).

IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT ADVERTISING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH ADVERTISING; THIS ALSO APPLIES TO PROFILING TO THE EXTENT THAT IT IS RELATED TO SUCH DIRECT ADVERTISING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT ADVERTISING (OBJECTION PURSUANT TO ART. 21(2) GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work, or the place of the alleged infringement. The right to lodge a complaint exists without prejudice to any other administrative or judicial remedies.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in fulfillment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done to the extent that it is technically feasible.

Information, rectification, and erasure

Within the framework of the applicable legal provisions, you have the right at any time to obtain free information about your stored personal data, its origin and recipients, and the purpose of the data processing, as well as a right to rectification or erasure of this data, if applicable. You can contact us at any time regarding this or any other questions about personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact us at any time to do so. The right to restriction of processing applies in the following cases:

  • If you contest the accuracy of the personal data we have stored, we generally need time to verify this. For the duration of this verification, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data was or is unlawful, you may request the restriction of data processing instead of erasure.
  • If we no longer require your personal data, but you need it for the exercise, defense, or establishment of legal claims, you have the right to request the restriction of the processing of your personal data instead of its deletion.
  • If you have filed an objection pursuant to Art. 21(1) GDPR, a balancing of your interests and ours must be carried out. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data—apart from its storage—may only be processed with your consent or for the establishment, exercise, or defense of legal claims, or for the protection of the rights of another natural or legal person, or for reasons of important public interest of the European Union or a member state.

SSL or TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognize an encrypted connection by the fact that the browser's address line changes from "http://" to "https://" and by the lock symbol in your browser line.

When SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

4. Data collection on this website

Cookies

Our websites use so-called "cookies." Cookies are small data packets that do not cause any damage to your device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are automatically deleted after your visit. Permanent cookies remain stored on your device until you delete them yourself or until they are automatically deleted by your web browser.

Cookies can be placed by us (first-party cookies) or by third-party companies (so-called third-party cookies). Third-party cookies enable the integration of specific services from third-party companies within websites (e.g., cookies for processing payment services).

Cookies serve various functions. Many cookies are technically necessary because certain website features would not function without them (e.g., the shopping cart function or the display of videos). Other cookies may be used to analyze user behavior or for advertising purposes.

Cookies that are required to perform electronic communication processes, to provide certain functions you have requested (e.g., for the shopping cart feature), or to optimize the website (e.g., cookies for measuring web traffic) are stored on the basis of Art. 6(1)(f) GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies to ensure the technically error-free and optimized provision of its services. If consent for the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively on the basis of this consent (Art. 6(1)(a) GDPR and § 25(1) TDDDG); consent can be revoked at any time.

You can configure your browser to notify you when cookies are set, allow cookies only in individual cases, exclude the acceptance of cookies for specific cases or in general, and activate the automatic deletion of cookies when closing the browser. If cookies are disabled, the functionality of this website may be limited.

You can find details about which cookies and services are used on this website in this privacy policy.

Server log files

The provider of these pages automatically collects and stores information in server log files, which your browser automatically transmits to us. This includes:

  • Browser type and version
  • Operating system used
  • Referrer URL
  • Hostname of the accessing computer
  • Time of server request
  • IP address

This data will not be combined with other data sources.

This data is collected on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimization of their website—for this, server log files must be collected.

Contact form

If you send us inquiries via the contact form, your details from the inquiry form, including the contact data you provide there, will be stored by us for the purpose of processing the inquiry and in the event of follow-up questions. We will not share this data without your consent.

The processing of this data is based on Art. 6(1)(b) GDPR if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of requests addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if requested; consent can be revoked at any time.

The data you enter in the contact form will remain with us until you ask us to delete it, revoke your consent for storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory statutory provisions—especially retention periods—remain unaffected.

Inquiry by email, telephone, or fax

If you contact us by email, telephone, or fax, your request, including all resulting personal data (name, request), will be stored and processed by us for the purpose of handling your inquiry.

The data you send to us via contact requests will remain with us until you ask us to delete it, revoke your consent for storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory statutory provisions—especially statutory retention periods—remain unaffected.

Google Analytics

This website uses functions of the web analytics service Google Analytics. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics enables the website operator to analyze the behavior of website visitors. In doing so, the website operator receives various usage data, such as page views, duration of stay, operating systems used, and the user's origin. This data is assigned to the user's respective device. No assignment to a specific User ID takes place.

Furthermore, Google Analytics allows us to record your mouse and scroll movements as well as clicks. Additionally, Google Analytics uses various modeling approaches to supplement the collected data sets and employs machine learning technologies for data analysis.

Google Analytics uses technologies that enable user recognition for the purpose of analyzing user behavior (e.g., cookies or device fingerprinting). The information collected by Google regarding the use of this website is generally transmitted to a Google server in the USA and stored there.

The use of this service is based on your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TDDDG. You may withdraw your consent at any time.

7. Proprietary services

Handling of applicant data

You have the option to apply for a position with us (e.g., via email, post, or our online application form). Below, we provide information regarding the scope, purpose, and use of the personal data collected during the application process. We assure you that the collection, processing, and use of your data will be carried out in accordance with applicable data protection laws and all other legal requirements, and that your data will be treated with strict confidentiality.

Scope and purpose of data collection

When you submit an application to us, we process the associated personal data (e.g., contact and communication details, application documents, notes from interviews, etc.) to the extent necessary to decide on the establishment of an employment relationship. The legal basis for this is Section 26 BDSG under German law (initiating an employment relationship), Art. 6(1)(b) GDPR (general contract initiation), and—if you have provided consent—Art. 6(1)(a) GDPR. Consent can be withdrawn at any time. Within our company, your personal data will only be shared with individuals involved in processing your application.

If your application is successful, the data you submitted will be stored in our data processing systems for the purpose of establishing the employment relationship, based on Section 26 of the German Federal Data Protection Act (BDSG) and Art. 6(1)(b) GDPR.

Data retention period

If we are unable to offer you a position, if you decline an offer, or if you withdraw your application, we reserve the right to retain the data you submitted for up to 6 months after the conclusion of the application process (rejection or withdrawal) based on our legitimate interests (Art. 6(1)(f) GDPR). Subsequently, the data will be deleted and physical application documents will be destroyed. Retention serves primarily as evidence in the event of a legal dispute. If it is evident that the data will be required after the 6-month period (e.g., due to an impending or pending legal dispute), deletion will only take place once the purpose for further retention no longer applies.

Data may also be stored for a longer period if you have provided your consent (Art. 6(1)(a) GDPR) or if legal retention requirements prevent deletion.

Inclusion in the applicant pool

If we do not offer you a position, we may have the option to include you in our applicant pool. If you are included, all documents and information from your application will be transferred to the applicant pool so that we can contact you regarding suitable vacancies.

Inclusion in the applicant pool is based exclusively on your explicit consent (Art. 6(1)(a) GDPR). Providing consent is voluntary and is not related to the ongoing application process. You may withdraw your consent at any time. In this case, data will be irrevocably deleted from the applicant pool, provided there are no legal grounds for retention.

Data in the applicant pool will be irrevocably deleted no later than two years after consent is granted.
